Every year right before Christmas insurance companies seem to be more willing to settle personal injury auto accident claims. Accident victims who’ve been unable to reach a settlement because of a disagreement over value may find the insurance company suddenly becoming more generous in December. Some industry insiders report carriers want to resolve as many claims as possible before year end for business or tax purposes. Others claim injury victims just want to receive settlement funds before the holidays. They claim their offices are flooded with more demands for settlement at this time of year and in order to clear the increased caseloads, they can’t put as much time into aggressive negotiations. While the reason for the phenomenon is unclear, experienced personal injury attorneys know this is a good time of year to settle claims. Many time their demands accordingly in order to take advantage of the trend. Others submit claims with perceived weaknesses knowing there may be increased pressure to settle on the part of the carrier. Whatever the reason for the difference in treatment from the insurance carriers, attorneys experienced in the field often use this time of year to the benefit of their clients.
